This privacy policy explains how Planning Data AI Ltd referred to as “we”, “us” or “our”) handle your personal data, including the types of personal data we collect about you, how your personal data may be used and when it may be disclosed, how we protect your personal data and the rights you have in relation to the processing of your personal data. Planning Data AI Ltd respects your privacy and we are committed to protecting your personal data in accordance with applicable data privacy laws and our internal policies.

We collect data in relation to planning applications from publicly accessible records on websites operated by local planning authorities.

3. How we use your personal data

We will only use your personal data for the purpose for which we collected it. This purpose is to operate a report based database of planning applications information which is made available to individuals or businesses that buy these reports from us. We collect that data on the basis that it is publicly available and that there is a legitimate interest for us in collecting this data and making it available to appropriate businesses and individuals.

4. How we share your personal data

We share personal data with businesses, individuals and customers that buy our services. We screen addresses against the Mailing Preference Service (https://www.mpsonline.org.uk/) to identify anyone who does not wish to be contacted for marketing purposes. Customers of ours including businesses are likely to have a legitimate interest in using this data to better understand land use and information relating to a property they may be involved in transacting upon. Those customers may use address and contact data obtained from our database to make enquiries which they reasonably consider would be of interest to a person who has made a particular type of planning application in relation to their transaction. However, they may only do this where they have a legitimate interest in that activity. 

We require customers to use data we provide them in compliance with the law and only for the purpose it was supplied by us to them. We also require them to provide anyone whose data they obtain from our database with an easy mechanism to opt-out of any communications.

5. International transfers

We will not transfer, store and process your personal data outside the UK or EEA apart from with Amazon Web Servers (AWS) which are held at a destination within the European Economic Area (“EEA”). AWS servers offer the highest level of security and are ISO 27001 compliant. If we transfer any data outside the EEA we will take steps to make sure adequate levels of privacy protection, in line with UK Data Protection legislation, are in place.  

6. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to personal data to those employees, agents, contractors and customers who have a business need to know. 

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements.
